§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to the use of the services offered at https://everyguides.com (hereinafter referred to as the “Website”), provided by:

§ 2 Description of Services

(4) The generated content is publicly viewable. Individual storage by the user is possible, but there is no entitlement to permanent availability.
(5) There is no registration requirement. Use is possible without creating a user account.
(6) Use is generally free of charge. However, the provider reserves the right to offer additional functions for a fee in the future. Information about such changes will be provided in a timely manner.
(7) The provider does not guarantee the functionality of the services or the suitability of the content for specific purposes.
(8) The provider reserves the right to include advertisements from third-party providers (e.g., Google Ads) on the website. These advertisements serve to refinance the offer and have no influence on the generated content.
§ 3 Content and Copyrights
(1) User-generated content is automatically processed and published thereafter. By clicking the “Generate New Instruction” button, the User declares to be authorized to use the submitted information.
(2) The User grants the Provider a spatially, temporally, and content-wise unlimited, transferable, non-exclusive right to use the AI-generated content. This includes, in particular, the right to publish, reproduce, modify, distribute, and make publicly accessible.
(3) The User will not be named. The Provider is not obliged to identify the author or contributor.
(4) The Provider assumes no responsibility for the legal admissibility, accuracy, or exploitability of the content. No editorial review takes place.
(5) The Provider provides the platform as a hosting service provider. The content is solely generated and submitted by Users. The Provider’s liability is limited to the scope of statutory provisions governing hosting services and is not liable for content if it is unaware of unlawful content or acts promptly after becoming aware.
§ 4 User Obligations
(1) The User undertakes not to generate any content that:
- violates applicable law,
- is racist, glorifies violence, insulting, sexist, or defamatory,
- infringes third-party rights, especially copyrights, trademarks, or personal rights.
(2) The Provider reserves the right to delete or block content at any time without giving reasons, particularly if legal violations are suspected.
(3) The User is obliged to use the Website’s services only within the legally permitted framework.
§ 5 Storage of IP Addresses
(1) For traceability of use and legal protection, the Provider stores the IP address of each User generating instructions via the platform.
(2) Storage is based on Art. 6(1)(f) GDPR (legitimate interest), in particular for:
- Evidence that content was initiated by Users and not by the Provider,
- Defense against possible third-party legal claims related to published content.
(3) IP addresses are not published and are not merged with other personal data. Disclosure to third parties occurs only within legally permissible limits, e.g., upon official request or for legal defense.
§ 6 Availability of Services
(1) The Provider strives to ensure an as trouble-free operation of the Website as possible but does not guarantee any specific availability or functionality.
(2) Maintenance, security, or capacity reasons as well as events beyond the Provider’s control (e.g., public network disruptions, power outages) may lead to temporary unavailability.
(3) The Provider may change or discontinue operation of the Website in whole or in part at any time. Users have no claim to the availability of the content they generated in such cases.
§ 7 Liability
(1) The Provider is not liable for the factual accuracy, timeliness, completeness, or legal admissibility of User-generated content.
(2) The Provider is liable only for damages caused by intentional or grossly negligent breach of duty. For simple negligence, liability is limited to the breach of essential contractual obligations (“cardinal obligations”) and only to the typically foreseeable damage.
(3) Liability for indirect damages, consequential damages, or lost profits is excluded.
(4) Any warranty for the functionality of the Website or generated content is expressly excluded.
(5) The provider is not liable for damage to health, injuries, or other physical impairments resulting from the application, implementation, or imitation of the instructions provided. Users are obliged to always check, on their own responsibility, whether instructions or recommendations can be carried out safely and do not pose any health risks before implementing them.
§ 8 Donations and Payment Processing
(1) The Website offers a donation link via the payment service provider Stripe. Donations are voluntary and without consideration.
(2) Payment processing is carried out by Stripe. The Provider assumes no liability for technical errors in payment or refunds.
(3) The right of withdrawal for donations is excluded as these are voluntary services without consideration.
(4) Personal data is transmitted to Stripe during payment processing. Users are referred to Stripe’s privacy policy.

The instructions automatically generated on this website are created with the help of artificial intelligence (AI). The content is not manually reviewed. There may be factual errors, incomplete information, or misleading statements. Use of these contents is at the user's own risk. No guarantee is made regarding the accuracy, completeness, timeliness, or suitability of the content for any specific purpose.
